Proposed Development

The Town has received a Complete Application for a Zoning Bylaw Amendment for the subject property. The Town is holding a Statutory Public Meeting to consider the proposed Zoning Bylaw Amendment application to facilitate an Agritourism Event Venue at 13969 Kennedy Road.

The applicant is proposing to construct a seasonal greenhouse-style structure which would be used to provide cover over a seating area during agritourism events related to the agricultural production on the property. It is the intention of the owner to sell food and drinks to visitors during these events from the structure. The structure would have capacity for approximately 100 people. The Event Venue would be supported by a gravel parking lot with 95 parking spaces.

What are the Proposed Changes?

  • To permit an Agritourism Event Venue as an On-Farm Diversified Use on the property
  • To apply the Assembly Hall parking rate for an Agritourism Event Venue
  • To specify the amount of area devoted to the Agritourism Event Venue

Any person may attend the Public Meeting in person or electronically and provide an oral submission either in support of or against the proposed Zoning Bylaw Amendment application. Written submissions in support of or against the proposed Zoning Bylaw Amendment application can also be provided at any time before or after the Public Meeting until such time as Council makes its decision on the application.

Appeal Procedure

In accordance with Bill 185, which received Royal Assent on June 6th, 2024, the Minister, the applicant, or a specified person, public body, or registered owner of any land to which the By-law will apply, who made oral submissions at a Public Meeting or written submissions to Town Council prior to the passage of the By-law, may appeal the By-law to the Ontario Land Tribunal. Third-party appeals are no longer permitted – meaning neighbours, individuals, companies, and ratepayer groups can no longer appeal development applications.

If a person or public body would otherwise have an ability to appeal the decision of the Town of Whitchurch-Stouffville to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Town of Whitchurch-Stouffville before the proposed Zoning By-law amendments are passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Whitchurch-Stouffville before the proposed Zoning By-law amendments are passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

That means if this proposed amendment or by-law is appealed to the Ontario Land Tribunal and you would like to participate in the appeal in some form, you must make an oral submission at a public meeting, or submit written comments to the Town Clerk, before the proposed amendment is adopted or the by-law is passed by Town Council.

In the event of an appeal to the Ontario Land Tribunal, your written submissions and contact information will be provided to the Tribunal. If you do not wish your contact information to be released to the Tribunal by the Town, please advise the Town accordingly in writing.

Notice of Decision
