Community Involvement:

The purpose of this Council Public Meeting is to consider a proposed Official Plan Amendment and Zoning By-law amendment. This is a way for you to offer input and get involved.

Location: 14622 Ninth Line
Scope of Application: The Town has received Official Plan Amendment and Zoning By-law Amendment applications, to permit the development of 11 residential lots for single detached dwellings, a park and a block for future residential development.

What are the Proposed Changes?

The Official Plan Amendment Application proposes to amend the Town’s Official Plan (“the Plan”), Community of Ballantrae-Mussleman’s Lake Secondary Plan, Mussleman’s Lake Community Area
To amend section 11.4.10 by creating a new section as follows:
11.4.10.X – 14622 Ninth Line (OPA22.004)

  • Notwithstanding other policies of this plan, servicing by private wells may be permitted on the subject lands
  • Notwithstanding other policies of this plan, major development (creation of 4 or more lots) may be permitted on the subject lands

The Zoning By-law Amendment Application proposes to amend the Town’s Zoning By-law (“the by-law”), current provisions and regulations for the Traditional Residential Village Zone:

To amend Section 5.4.2 to create a site-specific zone as follows:

  • 5.4.2.(x) – 14622 Ninth Line (ZBA22.008)
    Regulation - Required/Permitted
  • Minimum Lot Area - 0.05 hectares (550 square meters)
  • Minimum Lot Frontage - 10.0 meters
  • Minimum Exterior Side Yard Setback - 3.4 meters
    Minimum Interior Side Yard Setback - 1.8 meters on one side yard where 3.5 meters is provided on the opposite site side yard
  • Maximum Lot Coverage - 18%
  • Location of an accessory building - To permit a detached garage to be located closer to the street than the principal building on the lot.

Any person may attend the Council Public Meeting in person or electronically and make written and/or verbal representation either in support of or against the proposed Official Plan and Zoning By-law Amendment Applications. Appeal Procedure:

If a person or public body would otherwise have an ability to appeal the decision of the Town of Whitchurch-Stouffville to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Whitchurch-Stouffville before the proposed amendment is adopted or by-law is passed or refused, the person or public body is not entitled to appeal the decision of the Council of the Town of Whitchurch-Stouffville to the Ontario Land Tribunal.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Whitchurch-Stouffville before the proposed amendment is adopted or by-law is passed or refused, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
