Court Dismisses Bethesda Sports Park Legal Proceedings

The Ontario Superior Court of Justice has dismissed legal action related to the potential sale of Bethesda Sports Park involving the Town of Stouffville.

The proceeding, initiated by 2348219 Ontario Inc., alleged that the Town, Mayor Iain Lovatt and former Chief Administrative Officer Rob Adams breached contractual obligations in relation to a conditional offer received in 2021. From the outset, the Town maintained that the claim was without merit and that the Town acted in accordance with its contractual rights and responsibilities throughout the due diligence process.

“We are satisfied with the dismissal of this proceeding,” said Mayor Iain Lovatt. “This outcome reaffirms our position that the claim was without merit, the Town has a right to act in the best interest of the community and to make decisions guided by thoughtful planning and future growth considerations.”

Mayor Lovatt, and the Town, have consistently communicated that Bethesda Sports Park was never listed for sale and that the unsolicited conditional offer provided an opportunity for Council to explore potential enhancements to the Town’s recreational facilities. Ultimately, Council chose not to move forward with the opportunity.
