Notice of Adoption and Passing of By-laws Official Plan Amendment and Zoning By-law Amendment
This Notice is to advise you that in accordance with Section 34(18) and 16(23) of the Planning Act, 1990, the Council of the Corporation of the Town of Whitchurch-Stouffville at its meeting on June 4, 2025 has made the decision to:

Explanation of the Purpose & Effect of Official Plan Amendment and associated By-laws 2025-044-OP and 2025-045-ZO
- Amend Schedule “E” – Land Use Plan, to the Ballantrae-Musselman Lake and Environs Secondary Plan to redesignate the subject lands from ‘Institutional Area’ to ‘Highway 48 Corridor Commercial/Mixed-Use Area’.
- Amend Schedule 20 of the Town’s 2010 Comprehensive Zoning By-law 2010-001-ZO to rezone the Subject Lands from Institutional (I), to Commercial Residential Mixed - Ballantrae Exception (Two) zone [CMB(2)] as shown on Schedule 2 of the By-law; and to amend Section 6.4.7 Exceptions to the CMB Zone by adding a new Section 6.4.7.2 as Shown on Schedule 1 of the By-law.
Attached is a map of the Official Plan and Zoning By-law Amendment Area (see Page 3) and a copy of the Official Plan Amendment and By-laws passed by the Town of Whitchurch-Stouffville Council.
All written and oral submissions received by the Town of Whitchurch-Stouffville were considered in the making of this decision.
Filing of the Appeal
The last date for filing a Notice of Appeal is July 4, 2025. If no appeal is received by this time, the decision is final. A Notice of Appeal must:
- Be filed with the Clerk of the Town of Whitchurch-Stouffville.
- Set out the reasons for the appeal.
- Be accompanied by the fee required by the Ontario Land Tribunal (refer to https://olt.gov.on.ca/fee-chart/) by cheque made payable to the Minister of Finance.
- In addition, pursuant to By-law 2022-117-FI, a processing for Ontario Land Tribunal appeal, payable to the Town of Whitchurch-Stouffville, is required to be paid at the time of filing a Notice of Appeal.

The Ontario Land Tribunal may dismiss an appeal for reasons set out in Section 34(25) of the Planning Act.
The proposed official plan amendment is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of the council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
